The Employment Rights Bill 2024, published on Thursday 10th October, is set to make a considerable impact on businesses’ responsibilities to their workforce, particularly regarding inclusion and diversity. It is considered as the largest overhaul to employment law in a generation. The Bill details the new Labour government’s plans to amend the law regarding worker’s rights covering areas such as:

  • Sick pay entitlement from the first day of sickness
  • More right to flexible working
  • Making unfair dismissal claims a ‘day one’ right
  • Changes to minimum wage
  • Reviewing unpaid parental and bereavement leave
  • Changes to zero hours contracts
  • Updating Trade Union legislation
  • Banning ‘fire and rehire’ practices
  • Creation of a Fair Work Agency to ensure compliance and delivery of the new measures

These changes are not yet law, and current estimates set Autumn 2026 for the changes to take effect.

One of our principal consultants, Addison Barnett, says:

“These changes provide a breadth of opportunities to embed inclusive practice and policy into your organisation. Forward-thinking organizations will use these changes as an opportunity to create policies and practices that are sustainable, inclusive and impactful to everyone, setting them up to attract and retain talent.”

Immediate actions for organisations are to:

  • Undertake a policy audit to identify risks in your current policy suite
  • Develop a prioritised roadmap for amending and developing new policies that reflect best practice and are co-created with your staff e.g. staff networks, Union reps, D&I steering groups, and employee voice channels
  • Identify opportunities to embed inclusive best practice into your roadmap

Inclusion Manifesto: The tipping point of business accountability

We believe the UK General Election was a tipping point for inclusion and diversity in the UK. Knowing that the new Labour government would bring about a much-needed change and that businesses will be held to a new level of accountability for inclusion, we prepared the Inclusive Employers Inclusion Manifesto.

Download the Inclusion Manifesto

In the manifesto we identified three key shifts that will happen to the UK I&D landscape with Labour in power:

  • Increased regulation, reporting and stakeholder scrutiny
  • Changes to workers’ rights and equality laws
  • Strategically developing inclusive future-fit workforces

The launch of the Employment Rights Bill is the first step for the Labour government introducing the changes we predicted ‘Changes to workers’ rights and equality laws’.
